General Terms and Conditions

1.  Scope

The following GTC apply to all orders placed through our online shop by consumers and entrepreneurs.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly not attributable to their commercial or independent professional activity. An entrepreneur is a natural or legal person or a partnership with legal capacity who acts in the exercise of their commercial or independent professional activity when concluding a legal transaction.

With respect to entrepreneurs: If the entrepreneur uses conflicting or supplementary general terms and conditions, their applicability is hereby rejected; they will only become part of the contract if we have expressly agreed to them.

2.  Contracting party, conclusion of contract, correction options

The purchase contract is concluded with Gofurnit GmbH.

By listing the products in the online shop, we make a binding offer to conclude a contract for these items. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained in the ordering process. The contract is concluded by you accepting the offer for the goods contained in the shopping cart by clicking the order button. Immediately after submitting the order, you will receive a confirmation via email.

The language(s) available for the conclusion of the contract: German, English

4.  Delivery conditions

In addition to the stated product prices, shipping costs may apply. You can find more details about any applicable shipping costs in the offers.

We do not deliver to parcel stations.

5.  Payment

In our shop, the following payment methods are generally available to you:

Prepayment
If you choose the payment method prepayment, we will provide you with our bank details in a separate email and deliver the goods after receipt of payment.

Credit card
During the ordering process, you will enter your credit card details. Your card will be charged immediately after placing the order.

PayPal, PayPal Express
To pay the invoice amount via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg (“PayPal”), you must be registered with PayPal, authenticate yourself with your access data, and confirm the payment instruction. The payment transaction is carried out by PayPal immediately after placing the order. You will receive further information during the ordering process.

PayPal may offer additional payment options to registered PayPal customers selected according to its own criteria in the customer account. However, we have no influence on the offering of these options; any individually offered payment options relate to your legal relationship with PayPal. You can find more information about this in your PayPal account.

Sofort by Klarna
To pay the invoice amount via the payment service provider Sofort GmbH, Theresienhöhe 12, 80339 Munich, you must have a bank account enabled for online banking, authenticate yourself accordingly, and confirm the payment instruction. Your account will be charged immediately after placing the order. You will receive further information during the ordering process.

Google Pay
To pay the invoice amount via the payment service provider Google Ireland Ltd.,Gordon House, Barrow Street, Dublin 4, Ireland (“Google”), you must be registered with Google, have the Google Pay function enabled, authenticate yourself with your access data, and confirm the payment instruction. The payment transaction is carried out immediately after placing the order. You will receive further information during the ordering process.

Apple Pay
To pay the invoice amount via the payment service provider Apple Inc.,One Apple Park Way, Cupertino, CA 95014, USA (“Apple”), you must use the “Safari” browser, be registered with Apple, have the Apple Pay function enabled, authenticate yourself with your access data, and confirm the payment instruction. The payment transaction is carried out immediately after placing the order. You will receive further information during the ordering process.

giropay / paydirekt
In cooperation with the payment service provider paydirekt GmbH, Stephanstr. 14-16, 60313 Frankfurt a. M (“giropay” or “paydirekt”), we offer the payment methods giropay and paydirekt.

To pay the invoice amount via giropay, you must have a bank account enabled for online banking, authenticate yourself accordingly, and confirm the payment instruction. Your account will be charged immediately after placing the order. You will receive further information during the ordering process.

To pay the invoice amount via paydirekt, you must have a bank account enabled for online banking, be registered with paydirekt, authenticate yourself with your access data, and confirm the payment instruction.

Klarna
In collaboration with the payment service provider Klarna Bank AB (publ.),Sveavägen 46, 111 34 Stockholm, Sweden (“Klarna”) offers you the following payment options. Payment via Klarna is only available for consumers. Unless otherwise stated below, payment via Klarna requires a successful address and credit check and is made directly to Klarna. You will receive further information with each payment option and during the ordering process.

Purchase on account via Klarna
The invoice amount is due 30 days after the goods are shipped and the invoice is received.

Klarna credit card
During the ordering process, you will enter your credit card details. Your card will be charged by Klarna immediately after placing the order. No address or credit check will take place.

Klarna direct debit
You grant Klarna a SEPA direct debit mandate. Klarna will inform you about the date of the account charge (so-called prenotification). The account charge occurs after the goods are shipped.

Invoice
The invoice amount is due 14 days after receipt of the invoice and the goods via bank transfer to the bank account specified in the invoice. We reserve the right to offer the purchase on account only after a successful credit check.

6.  Right of withdrawal

Consumers have the statutory right of withdrawal as described in the withdrawal instruction. Entrepreneurs are not granted a voluntary right of withdrawal.

7.  Retention of title

The goods remain our property until full payment is received.
For entrepreneurs, it additionally applies: We reserve the right of ownership of the goods until all claims from an ongoing business relationship are fully settled. You may resell the retained goods in the ordinary course of business; all claims arising from this resale, regardless of whether the retained goods are connected or mixed with a new item, are assigned to us in advance in the amount of the invoice amount, and we accept this assignment. You remain authorized to collect the claims; however, we may also collect claims ourselves if you do not meet your payment obligations. We will release the securities to which we are entitled upon your request to the extent that the realizable value of the securities exceeds the value of the outstanding claims by more than 10%.

8.  Transport damages

For consumers: If goods are delivered with obvious transport damages, please report such defects as soon as possible to the carrier and contact us immediately. The failure to make a complaint or contact has no consequences for your statutory rights and their enforcement, particularly your warranty rights. However, you help us assert our own claims against the carrier or the transport insurance.

For entrepreneurs: The risk of accidental loss and accidental deterioration passes to you as soon as we have delivered the item to the freight forwarder, the carrier, or any other person or institution designated to carry out the shipment.

9.  Warranty and guarantees

9.1 Liability for defects

The statutory liability for defects applies.

9.2 Guarantees and customer service

Information on any additional guarantees that may apply and their exact conditions can be found with each product and on special information pages in the online shop.

10.  Liability

We are always fully liable for claims arising from damages caused by us, our legal representatives, or our agents.

  • in the event of injury to life, body, or health,
  • in the event of intentional or grossly negligent breach of duty,
  • in the case of guarantee promises, as far as agreed, or
  • as far as the scope of the Product Liability Act is opened.

In the event of a breach of essential contractual obligations, the fulfillment of which enables the proper execution of the contract and on which the contracting partner may regularly rely (cardinal obligations), our liability for slight negligence is limited to the damage foreseeable at the time of the conclusion of the contract, the occurrence of which must typically be expected.
Otherwise, claims for damages are excluded.

12.  Agreement for the use of Trusted Shops buyer protection

You can secure orders placed with us free of charge up to an order value of 100 euros through the buyer protection of Trusted Shops AG. In addition, Trusted Shops offers a paid protection option in cooperation with a guarantor. The Trusted Shops buyer protection conditions apply, which you can find here. The conclusion of buyer protection occurs by clicking on the appropriately labeled button of the so-called Trustcard, which appears as a pop-up on the order thank-you page after an order is placed. To offer you buyer protection, the Trustcard must access order data stored in your browser's cache. The access is purely local, and no order data is transmitted to Trusted Shops before you actively choose buyer protection or consent to the transmission of order data to Trusted Shops. If your consent is given, a hash value of your email address, as well as the order number and order amount, will be transmitted to Trusted Shops. If you are already registered for buyer protection, your order will be automatically secured. If you are not yet registered for buyer protection, you can register via the Trustcard as described above. Information on data protection at Trusted Shops is attached to the buyer protection conditions linked above.

13.  Dispute resolution

The European Commission provides a platform for online dispute resolution (ODR), which you can find here. We are willing to participate in an out-of-court settlement procedure before a consumer arbitration board.

If you are an entrepreneur, German law applies, excluding the UN Sales Convention.
